Federal Judges Deliver Definitive Blows to Trump’s Election Executive Orders, Halting Voter List Overhaul and USPS Delivery Restrictions
The Trump administration's sweeping campaign to assert federal executive control over state election administration suffered a pair of massive, back-to-back judicial defeats in Boston in late June 2026. Within a 24-hour window, two federal judges blocked key pillars of President Trump's electoral overhauls, reaffirming that the U.S. Constitution does not grant the executive branch authority over the administration of federal elections.1

"There is no evidence in this record of widespread 'illegal voting, discrimination, fraud, and other forms of malfeasance and error' within American elections, which the Executive Order purports to safeguard against."
The following day, on Thursday, June 25, 2026, U.S. District Judge Indira Talwani issued a preliminary injunction halting President Trump's second election-related executive order (signed March 31, 2026). This order had directed the Department of Homeland Security (DHS) to compile voter eligibility databases and instructed the U.S. Postal Service (USPS) to deliver mail-in ballots only to voters on those federally approved state lists. Postmaster General David Steiner had previously warned Congress that the USPS would halt ballot deliveries in states that refused to provide their voter lists.
Siding with a coalition of 23 Democratic-led states and the District of Columbia, Judge Talwani declared major portions of the order unconstitutional, ruling that the president had exceeded his authority by trying to overhaul procedures that have been managed by states and local governments since 1789.
"The Constitution does not grant the President any specific powers over elections," Judge Talwani wrote, adding that the president lacked the authority to direct DHS to compile eligibility lists, and that the USPS had no statutory authorization to adopt binding regulations on mail-in voting3.
Judge Talwani barred the administration from enforcing the order ahead of the November 3, 2026 midterm elections and ordered the government to submit a compliance report by early July. These back-to-back setbacks represent a major victory for state election officials and voting rights advocates who warned that the administration's federal mandates would trigger widespread chaos and voter disenfranchisement under the guise of security.
