The Trump administration's aggressive legal campaign to force states to surrender complete, unredacted voter registration records has hit a near-total roadblock in the federal judiciary. The Department of Justice's Civil Rights Division, led by Harmeet Dhillon, has lost all 16 federal court decisions issued so far1. The legal defeats are notable because they are bipartisan: Republican election officials in states like Utah, Idaho, Kentucky, and West Virginia are actively fighting the federal demands, and seven of the fifteen U.S. District Court judges who have ruled against the administration are Trump appointees.

On July 14, 2026, federal judges dismissed the DOJ's lawsuits against Virginia and New Mexico. In the Virginia case, U.S. District Judge Roderick Young—a Trump appointee—ruled that federal law does not require the state to hand over unredacted voter lists. The same day, U.S. District Judge Judith Herrera (appointed by George W. Bush) tossed the lawsuit against New Mexico, ruling that the DOJ failed to establish "the basis and the purpose" for its demand.

Despite these legal setbacks, the administration is dramatically escalating its pressure on state election officials. Following a primetime address on July 16, Department of Homeland Security (DHS) Secretary Markwayne Mullin sent letters on July 17 to election officials in California, Pennsylvania, New Jersey, and Nevada, urging them to check voter rolls using the federal Systematic Alien Verification for Entitlements (SAVE) database. Mullin publicly threatened state officials with criminal prosecution, including fines and potential prison time, if they do not comply. This escalation comes despite a federal judge in Washington, D.C., having previously blocked the SAVE database overhaul on June 22, 2026, after finding it "unreliable" for voter roll purges.
