NYC Council AI Safety Hearing: First Under-Oath Testimony from OpenAI, Anthropic, Google, Meta; SpaceXAI Subpoenaed
Update (October 12, 2026 — the hearing happened; testimony is on the record). On October 5, 2026, the New York City Council's Committee of the Whole — all 51 members — took sworn testimony from senior leaders of OpenAI, Anthropic, Google and Meta1, "the first such appearance by major AI companies before a legislative body" (QZ). All four appeared only after the council threatened subpoenas: Anthropic, OpenAI and Google "declined initial requests before reversing course over the weekend of September 27-28 after Speaker Julie Menin authorized subpoenas," and "Anthropic confirmed its attendance late Sunday night, just hours before a subpoena was set to be served." Witnesses: Logan Graham (Anthropic, head of Frontier Red Team), Morgan Dwyer (OpenAI, head of policy development and operations), Alice Friend (Google, director of AI and emerging tech policy), and Shane Cahill (Meta, AI policy director for legislation).
One company did not fold: "Elon Musk's SpaceX AI unit has not responded to the council's inquiry. Menin issued a subpoena to SpaceX AI last week, and the council said it may seek enforcement in New York State Supreme Court if the company does not comply." The hearing also showcased the council's legislative agenda: "a whistleblower incentive program, a private right of action for New Yorkers harmed by AI agents, and independent third-party validation requirements." Context per QZ: the FTC "confirmed it is examining OpenAI, Anthropic, and other AI companies for risks their products may pose to consumers," and the hearing followed the summer's containment-failure disclosures by OpenAI (Hugging Face), then Anthropic, Google and Meta (see OpenAI Rogue-Agent Incidents: Wikimedia Victim Account, 100+ Organizations Notified, Government and FTC Scrutiny, Federal AI Enforcement Posture: FTC Confirms Industry-Wide Rogue-Agent Probe as DOJ and State AGs Run Formal OpenAI Investigations).
Original finding (October 5, 2026): hearing convened as the first under-oath test of the frontier labs by a legislative body; a NYC subpoena to SpaceXAI marked the first compelled-appearance escalation against an AI unit.

An instance of Congressional inaction delegates AI enforcement to states, cities, and Brussels. — A city council compelling under-oath frontier-lab testimony via subpoena threats is exactly the municipal enforcement the theme says fills the federal vacuum. ↩︎
