Federal Judges Deliver Definitive Blows to Trump’s Election Executive Orders, Halting Voter List Overhaul and USPS Delivery Restrictions
The Trump administration's sweeping campaign to assert federal executive control over state election administration suffered major judicial defeats in late June and August 2026. Federal judges in Boston issued nationwide preliminary injunctions blocking the implementation of President Trump’s March 31, 2026 Executive Order 143991, "Ensuring Citizenship Verification and Integrity in Federal Elections," which sought to restrict mail-in voting and mail ballot delivery.
USPS Finalizes Mail Ballot Rule But Faces Enforcement Block
On August 21, 2026, the U.S. Postal Service (USPS) finalized its controversial mail-ballot rule (scheduled for publication in the Federal Register on August 26, 2026) to implement Section 3 of Executive Order 14399. Under the finalized rule, states and election officials would be required to submit voter names, addresses, and barcode information through a new Federal Ballot Mail Portal, and use envelopes with the official Election Mail logo before outbound ballots could be accepted by postal workers.2 Non-compliant mailings would be rejected.
However, because of the active federal court injunctions, USPS announced in its final rule that it will not take action to enforce these new requirements for the November 3, 2026, general election unless a court lifts the restrictions. The Trump administration has petitioned the U.S. Supreme Court to lift the injunctions and allow the executive order to take effect before the midterms.
Immediate Legal Backlash and Motion to Enforce Injunction
The finalized rule sparked immediate legal pushback. On August 22, 2026, a coalition of voting rights organizations—including the League of Women Voters, OCA-Asian Pacific American Advocates, and the NAACP Legal Defense Fund—filed an emergency motion to enforce the preliminary injunction in the U.S. District Court for the District of Massachusetts (League of Women Voters of Massachusetts v. Trump).
The plaintiffs argue that completing the rulemaking and making it effective "immediately" violates Judge Indira Talwani's August 11, 2026 preliminary injunction, which explicitly barred USPS from "implementing" Section 3 of the executive order and "completing rulemaking" for the 2026 elections. The groups warn that the threat of last-minute changes to mail voting rules risks widespread confusion and chaos.
In a joint statement, the plaintiff organizations and their counsel declared:
"A federal district court issued a preliminary injunction less than two weeks ago to stem the chaos caused by this executive order. By issuing this final rule, the Trump administration has flouted the court’s injunction. The final rule threatens further chaos for voters, civic organizations, and election officials by seeking to impose last-minute changes to mail voting rules."
Michael McNulty, senior policy director for Issue One, added that the rule represents:
"an attempt to weaponize USPS as part of the Trump administration’s efforts to take over elections... postal workers shift from neutral transporters of a state-led process to a federal gatekeeper of states’ outbound mail ballots."
