Pennsylvania has emerged as a major battleground and policy leader in managing the AI data center buildout. On May 13, 2026, the Pennsylvania Public Utility Commission (PUC) officially adopted a first-of-its-kind Large Load Model Tariff Framework (Docket M-2025-3054271). The framework establishes a strict "but for" cost allocation standard, requiring large-load customers to cover 100% of any infrastructure and connection costs that would not have been triggered "but for" their interconnection¹, regardless of whether other customers might eventually benefit.

PPL Electric's Landmark Large-Load Tariff Approval

On June 4, 2026, the Pennsylvania PUC issued a final decision in PPL Electric Utilities’ base rate proceeding (Docket R-2025-3046030), modifying and approving a Joint Petition for Settlement. This landmark ruling formally implemented the state's first major large-load tariff modeled after the PUC's framework.

Key provisions of PPL Electric’s approved large-load tariff include:

• Applicability: The tariff applies to any customer with a peak electric demand of 50 MW or greater at a single facility, or 75 MW or greater in the aggregate across facilities taking service at or above 69 kV within a 10-mile radius.
• Commitment Terms: Large-load customers must sign service agreements with an initial term of not less than 10 years, a maximum load ramp-up schedule of five years, minimum load guarantees (typically billing for at least 80% of contracted capacity), and early termination exit fees.
• Low-Income Program Support: To directly offset the impact of the utility's broader 4.9% residential rate hike (which raised average residential bills to about $184 a month), the tariff mandates that large-load customers collectively provide $11 million per year to fund PPL Electric’s residential low-income assistance program.

Massive Interconnection Pipeline and System Risks

The urgency behind Pennsylvania's regulatory push is highlighted by the sheer scale of the state's data center pipeline. PPL Electric's interconnection queue includes approximately 20 GW of contracted large loads. For context, PPL Electric’s existing system peak load is only 7.8 GW.

This means the utility is preparing to more than double its entire historical system demand in just 5 to 6 years—a level of growth that previously took over a century to achieve. Without the newly approved tariff, the multi-billion dollar cost of reinforcing the transmission and distribution grid to support this 20 GW wave would have been socialized among PPL's 1.5 million existing residential and commercial customers.
