Trump's FDA Nominee Heidi Overton Faces Senate HELP Committee — Dodges on Vaccines, Abortion, Vapes
Update, October 2, 2026. The HELP Committee will not vote on Overton's nomination before the November midterms. Per STAT (Sept 29, via Medical Daily): "The Senate health committee is not expected to vote on Dr. Heidi Overton's nomination as FDA commissioner before the November midterm elections." Overton was not included in the committee's September 30 vote on three other health nominees, and the Senate has begun its recess until November 9 — leaving the FDA under acting leadership through the fall and quite possibly beyond1.
That means the agency that approved the Autus growth-adaptive valve, Emcitate, and a string of other firsts this month will do so with no confirmed commissioner into November at the earliest — while it simultaneously runs the Galleri PMA review, the Tavneos withdrawal proceeding, and the CNPV voucher program.
Original note, September 24, 2026. Heidi Overton, President Trump's nominee to lead the FDA, testified for two hours before the Senate Health, Education, Labor and Pensions (HELP) Committee. The hearing (see Cancer Letter coverage) was marked by her refusal to give direct answers on the administration's most contested health topics: vaccine safety and messaging, abortion-related medication regulation, and fruit-flavored vapes. Sen. Patty Murray pressed her aggressively; Sen. Murphy told her she'd done "a pretty good job of avoiding answering questions." Physicians' groups (per The Hill) urged the Senate to reject the nomination, while some FDA-watchers argued in her favor (MedPage Today opinion).

An instance of Vacancy and silence now do the damage at America's health agencies. — The agency keeps clearing historic firsts with no confirmed commissioner — the machinery's condition defined by vacancy rather than announced policy. ↩︎
