OPM Strips Civil Service Protections with "Schedule Policy/Career" Implementation Guidance

On Monday, June 8, 2026, the Office of Personnel Management (OPM) issued detailed implementation instructions for federal agencies to execute President Trump's June 3 executive order reclassifying approximately 8,000 career federal employees into "Schedule Policy/Career"1 (Schedule P/C). The guidance paved the way for agencies to meet a critical June 10, 2026 deadline to formally complete reclassifications and update personnel files.

Under the new guidance, reclassified employees are stripped of long-standing civil service protections, effectively becoming "at-will" workers. Agencies are authorized to fire Schedule P/C employees using a "one-step action" without advance notice, performance improvement plans (PIPs), or the right to appeal to the Merit Systems Protection Board (MSPB). Furthermore, converted employees are required to sign a notice acknowledging their at-will status, and they lose eligibility for pay-based retention, recruitment, or relocation incentives, as well as student loan repayment options.

While the administration claims whistleblower protections remain intact, federal unions warn that routing prohibited personnel practice claims through internal agency general counsels, rather than independent systems, will have a severe chilling effect on reporting.

Key Evidence

OPM's guidance details the rapid "one-step" disciplinary and termination process for the newly reclassified workers:

"In cases where Schedule Policy/Career employees are being disciplined or fired, agencies also do not need to create procedures for giving advance notice to personnel. The discipline procedures are now 'one-step actions,' OPM said... Converted employees... must sign a notice acknowledging what their conversion means. The acknowledgement requires reclassified employees to confirm they understand their position is now in the excepted service, at-will and exempted from civil service protections."

Federal unions and employee organizations have strongly condemned the move, warning of a return to a politicized spoils system:

"Thousands of employees who were hired under the nonpartisan, professional civil service will be converted to a new hiring schedule where they can be fired 'at will' by political appointees or other overseers with essentially no procedural or appeal safeguards... Workers who once felt comfortable reporting waste, fraud, abuse, and mismanagement at their place of employment because they were protected from retaliation will now be afraid for their jobs if they speak out."

Trump Strips Due Process Rights from Thousands of Federal Workers in Continued Push to Politicize Civil Service

Significance

The rapid rollout of Schedule Policy/Career (the renamed Schedule F) represents a profound consolidation of executive authority over the federal bureaucracy. By establishing a separate presidential awards program and bonus pool for cooperative Schedule P/C employees while stripping due process from dissenters, the administration is structurally shifting the civil service toward political loyalty. The immediate legal challenges brought by coalitions of federal unions (such as AFGE and NTEU) represent the primary remaining barrier to this sweeping transformation2 of the administrative state.

  1. An instance of Excepted service schedules replace career civil service protections with at-will political obedience. — The guidance authorizes federal agencies to move thousands of career officials into excepted status, removing their civil service protections and establishing at-will employment rules. ↩︎

  2. An instance of Centralizing executive control over the military and civil service triggers automatic institutional backlash. — Aggressive moves to strip due process rights from federal workers trigger instant, organized legal pushback from civil service labor organizations. ↩︎
