FDA Approves Colorado's Canadian Drug Importation Program Amid Steep Supply and Policy Hurdles
On June 15, 2026, the U.S. Food and Drug Administration (FDA) approved Colorado’s multi-year application to import lower-cost prescription drugs from Canada under Section 804 of the Federal Food, Drug, and Cosmetic Act. This landmark decision makes Colorado only the second state in the nation, after Florida in 2024, to receive federal authorization to run a bulk drug importation program.
The two-year authorization allows Colorado’s Department of Health Care Policy and Financing (HCPF) to submit "pre-import requests" to the FDA for 20 specific high-cost brand-name drugs. The state's approved list includes major therapeutics such as Gilead's HIV treatment Biktarvy, Bristol Myers Squibb's blood thinner Eliquis, Novo Nordisk's blockbuster GLP-1 weight-loss drug Ozempic, AbbVie's JAK inhibitor Rinvoq, and Vertex's cystic fibrosis triple-therapy Trikafta. Colorado officials estimate that the program could save state residents up to $46 million over three years through lowered out-of-pocket expenses and insurance premiums.
Despite the federal green light, Colorado faces the same formidable supply-chain and geopolitical obstacles that have stalled Florida's program. Health Canada has established strict regulatory safeguards to protect its domestic market, making it illegal to export Canadian drugs if doing so would cause or worsen a shortage1 for Canadian patients. Furthermore, U.S. drug manufacturers are highly unlikely to cooperate, and the state must find willing Canadian wholesalers and exporters to source the products.
